1. Introduction to WEEE

The WEEE Directive (2012/19/EU) is a key legal document of the European Union that regulates issues related to Waste Electrical and Electronic Equipment (WEEE). Its primary goal is to protect the environment and human health by ensuring effective management of waste originating from electrical and electronic equipment (EEE). The directive establishes regulations for the collection, processing, recycling, and recovery of such waste to reduce its negative environmental impact.

2. Scope of the WEEE Directive

The WEEE Directive applies to all electrical and electronic devices whose operation depends on electric power or electromagnetic fields. It covers equipment intended for both individual consumers and professional users. Certain specialized devices, such as military equipment or large-scale stationary industrial installations, are exempt.

The directive mandates the selective and responsible collection of waste, with specific targets for WEEE collection to optimize recycling processes and minimize landfill waste.

3. The crossed-out wheeled bin symbol – meaning and variations

One of the key elements of the directive is the requirement to mark equipment with the crossed-out wheeled bin symbol. This symbol informs users that the device cannot be disposed of with regular household waste but must be collected separately. There are two variations of this symbol:

a) Symbol without an underline

This marking is used when the manufacturer adheres solely to the requirements of the WEEE Directive. The symbol without an underline indicates compliance with the basic principles of the legislation, without reference to additional standards.

b) Symbol with an underline

This version is used when the manufacturer bases the marking on harmonized standards that specify additional technical and quality requirements. The underline indicates that the device meets not only the directive’s requirements but also certain European standards, often perceived as a higher compliance standard.

4. Requirements for placing the symbol

Under the WEEE Directive, the crossed-out wheeled bin symbol must be placed visibly, legibly, and permanently on the device. If technical reasons make this impossible, the symbol can be included on the packaging or in the technical documentation provided with the device.

a) Minimum size of the symbol

The symbol’s height must be at least 7 mm to ensure readability and visibility. For very small devices, proportional reduction is allowed, provided the symbol remains legible. The manufacturer must ensure the symbol remains visible throughout the device's lifespan.

b) Placement of the symbol

Preferably, the symbol should be placed directly on the device's casing to ensure the user notices the obligation for selective waste collection. If this is not feasible, it may be placed on the device label or in the user manual.

5. Importance of compliance with the WEEE Directive

Proper marking and compliance with the WEEE Directive are crucial for environmental protection. The selective collection of electrical equipment facilitates the recovery of valuable materials, such as precious metals, and minimizes the harmful impact of hazardous substances (e.g., mercury, cadmium) on the environment. The directive also supports the principle of producer responsibility by obligating manufacturers to finance waste collection and processing.

6. Penalties for non-compliance

Failure to comply with the WEEE Directive, including improper marking, can lead to severe legal and financial consequences. EU member states are required to implement effective and deterrent penalties, which may include fines, product recalls, or other administrative actions.
